The CORPS has done it again. They have dropped another bomb on the efforts to open Cedar Bayou and Vinson Slough. After years on working to obtain a permit to open the peoples passes, the CORPS has found yet another way to derail our efforts. After years of submitting and the CORPS reviewing 3 permits and answering all the comments and meeting all requirements, the CORPS will try and force us to access the Gulf to dredge Cedar Bayou and Vinson Slough at an additional cost of up to $500,000. The dredge projects before have always access the Cedar Bayou Channel by way of Mesquite Bay Channel. There was never an issue raised about this access route until now. The County will address this request for the planned access route. As soon as I hear about the CORPS response, I will up date you as to where we are. Needless to say,the Judge is not happy. Lynn,

     What reason did they give for this stupidity? The San Bernard river channel was just recently restored by dredging from the ICW to the beach. A direct line through the dunes, beach and all. Not following the recent channel, but the most direct path to the Gulf. If the Corps did not require that project to come in from the surf, why would they require CB/VS to do so?

In January of 2008, the CORPS put the money up, along with $500,000 from the State, and the CORPS dredged the San Bernard River during the Whooping Crane season. The CORPS cut right though all the seagrass, straight though to the Gulf. Col. Weston made this statement, (The state will add an extra $500.000 to help the CORPS project, said Texas Department of Transportation engineer, Scott Sullivan. Weston said with the Texas agency's help they fulfill the CORPS' need for a local governmental sponsor. He added that it is better for them to take on the project rather than the state because they would spend a large chunk of money just getting a Corps permit for the underwater work. The nice thing about us taking this on is we don,t have to go through us to get a permit, Weston said. Which is nice because we're not easy to get a permit from. end quote) Now, today the CORPS wants an access route plan though Mesquite Bay, to avoid prop-washing in the channel which has just been maintained June of this year.
 Go figure!

Because of concerns from the private land owners on San Jose Island. If you ever had any doubt as to why we couldn't get the permit, well I'll quote a comment directly from the CORPS for you:

"Also, I need to emphasize that all concerns from the San Jose Island property owners involving their property rights must be resolved, and I have enclosed the comment letter sent on their behalf"

Mesquite Bay is OURS, anything below the tidal means line is OURS! The property owners don't want boats interrupting their private paradise and the CORPS seems to agree. As anglers, outdoors people, and TAX PAYERS we should be screaming about this! Will we sit by and watch an eco-system and economy crash due to a wealthy family? I won't.

Agreed J Dean - we just fished CB this weekend and it was an incredible sight. Sand bridges in places where water once flowed. Heartbreaking to say the least. We are on the cusp of getting the channel opened back up and shouldn't let a single interest stand in the way. Other than deep pockets, how does this differ from the state's treatment of the Boliver Peninsula homeowners who lost their property boundaries due to hurricane Ike and were facing losing their land to the state? It's a double standard. Why didn't the state take up for them?

It was way too quiet in here the past couple of weeks.  My fears have been confirmed.

But I do have a suggestion.  Why not hold up the approved plan for everyone to see?  You know, the one that showed how this operation was to be strategically accomplished.

I said before on Lynn's "Huge Mistake" thread that if the so called conservation groups would truly get on board with this issue, those passes would get opened. We are fighting wealthy, powerful, evil people who are perpetrating this abomination. Where are you CCA? Where are you RFA? I have nothing against well meaning members, but it's time for leadership of these groups to put their money where the mouth is. I already quit CCA and joined RFA. I pray these groups don't prove themselves to be phoney, but in the absence of any real substantive action on their part, I am left with only one conclusion. Argue with me if you want, but from now on my "membership dues" are going to go directly to SCBI only. I would urge all interested parties to do the same because the only remedy I see is going to require legal action. How many years does it take to face the truth? Take your STAR tourney and dues to either organization and create a legal fund so SCBI can do something. Lynn, you may not like this, I'm only making a suggestion. No offense intended. You created the organization and have all the blood sweat and tears in it. I wish the best for you. Old Plugger

The CORPS has thrown up another road block in hopes that time will run out for us to have a chance at the CIAP funds to reopen Cedar Bayou and Vinson Slough, which most observers interpet as a death knell for the opening of these two historic passes. The failure of the CORPS to act in a responsible manner is all the more confounding and frustrating. However, this new road block only makes our work and voices more necessary. As long as we care about those two passes and the future we're leaving for our children and grandchildren, we must continue to fight. Remember, the issue of these passes, open and flowing again, isn't going away. And neither can we. The entire bay system and the passes are getting worse, so we have to redouble our efforts. We are planning our next step for the reopening these passes, and I'm counting on your continued involvement.  The CORPS last request was a major disappointment, but there is a silver lining. Supporters like you have organized on an unprecedented scale. We have built overwhelming popular support for the reopening of these our passes. The Federal and State agencies want to keep these passes closed, killing our natural resources, wetlands, the Whooping Cranes, and people and making this seven bay system an open sewer for dumping of pollution. The Federal, State agencies and the CORPS inaction reflects that reality. We have always known that solving the problem with these two passes, was a generational challenge---and the urgency of the opening of these passes demands that despite these substantial obstacles, we must fight for every inch of progress. It has never been more clear and the evidence is mounting day by day. For those of us who understand the stakes, it's a moral obligation. So we must fight even harder. Together, we must continue to beat back those repeated assaults on the authority of the CORPS. We must continue to pressure our elected leaders--local, state,and national-- to stand with us instead of these State and Federal agencies and the CORPS. We must each take individual action to transition to open passes and healthy ecosystems into our daily lives. We will win the battle of The People against the CORPS.
